Probate Avoidance

Most people have a written will and think that their estate is safe. However, even families with written wills will still have to go through the probate process.

The legal requirement for a court initiated probate is, if the deceased individual has individual assets in their name alone exceeding $100,000, the family will have to go through a formal probate process in order to access those assets.
